Terms of Service

1. Agreement to Terms

By accessing and using Lilac Venus (the "Service"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately stop using our services. These terms constitute a legally binding agreement between you and Lilac Venus.

2. Service Description

Lilac Venus is an emergency response platform that connects users in distress with pre-verified responders across South Africa. Our services include:

  • SOS alert functionality with real-time location sharing
  • Verified responder network dispatch and coordination
  • Emergency contact notification system
  • Safety features including safe zones, route analysis, and check-ins
  • Subscription tiers: SOS Basic (R30/month), Lilac Individual (R75/month), and Safety Circle (R99/month)

Important: Lilac Venus operates only within South Africa and is NOT a replacement for official emergency services (10111, medical services).

3. Eligibility

  • Must be 13 years or older to use Lilac Venus
  • Users under 18 years require parental or guardian consent
  • Must provide accurate and truthful information during registration
  • Must comply with all South African laws and regulations
  • Must not be prohibited from using the service under any applicable laws

4. User Accounts

Account Creation:

  • Accurate information is required for registration
  • One account per person (multiple accounts are prohibited)
  • You are responsible for keeping your credentials secure
  • You must notify us immediately of any unauthorized access

Account Responsibilities:

  • You are responsible for all activity under your account
  • Keep contact information and emergency contacts current and accurate
  • Maintain proper location permissions for the app to function
  • Report any security concerns or suspicious activity immediately

Account Termination:

  • You can delete your account at any time through app settings
  • We may suspend or terminate accounts for violations of these terms
  • No refunds for mid-billing-cycle cancellations (except as required by law)
  • Data retention follows our Privacy Policy after account deletion

5. Emergency Services Disclaimer

IMPORTANT - READ CAREFULLY:

  • • Lilac Venus is NOT a substitute for 10111 or official emergency medical services
  • • If you are in immediate life-threatening danger, call 10111 FIRST
  • • Response times vary based on responder availability and location - we cannot guarantee specific arrival times
  • • Responders are volunteers or independent contractors, not emergency medical technicians (unless designated as Medical Responders)
  • • Service depends on network connectivity, GPS availability, and responder availability
  • • Verified responders act independently - Lilac Venus is not liable for their actions or inactions

No Warranty of Service: The service is provided "as is" with no guarantee of availability, response times, or outcomes. Technical issues, network outages, or GPS inaccuracies may affect service delivery.

6. Acceptable Use

You Agree To:

  • Use the SOS feature only for genuine emergencies
  • Provide accurate information in your profile and during emergencies
  • Respect other users, responders, and support staff
  • Follow our Community Guidelines at all times
  • Not misuse, abuse, or exploit any platform features
  • Cooperate with dispatched responders during emergencies

You Agree NOT To:

  • Make false emergency reports or test the SOS system unnecessarily
  • Harass, threaten, stalk, or abuse other users or responders
  • Attempt to hack, compromise security, or reverse engineer the app
  • Share other users' personal information publicly
  • Use the service for any illegal purposes
  • Create fake profiles, multiple accounts, or impersonate others
  • Abuse free trials or create accounts to bypass subscription requirements

7. Responder Terms

For Verified Responders, the following additional terms apply:

  • Must maintain valid credentials, certifications, and professional qualifications
  • Respond only when on-duty, available, and able to safely assist
  • Follow the Responder Code of Conduct and professional standards
  • Maintain confidentiality of all incident information
  • Report incidents accurately and completely
  • Coordinate effectively with other responders and emergency services
  • Lilac Venus reserves the right to suspend or remove responders at any time for violations

Responder Liability: Responders act as independent contractors. Lilac Venus is not liable for responder actions, inactions, negligence, or misconduct. Responders are strongly encouraged to carry their own professional liability insurance.

User Release: By using Lilac Venus, users release and hold harmless Lilac Venus from any claims related to responder conduct or emergency outcomes.

8. Subscription Terms

Billing:

  • SOS Basic: R30/month
  • Lilac Individual: R75/month or R750/year
  • Safety Circle: R99/month or R990/year (covers up to 8 users)
  • Prices subject to change with 30 days advance notice
  • Billing processed through app stores or our secure payment processor
  • Automatic renewal unless canceled before the next billing cycle

Refunds:

  • No refunds for partial months of service
  • Annual plans: Pro-rated refund available within 14 days if service unused
  • No refunds for account violations or terminations
  • Contact support for billing disputes: support@lilacvenus.co.za

Cancellation:

  • Cancel anytime from Settings → Subscription
  • Service continues until the end of your current billing period
  • No partial refunds for early cancellation
  • Data is retained according to our Privacy Policy

Safety Circle Plans:

  • Plan owner is responsible for all billing
  • Plan owner can add/remove members at any time
  • Removed members immediately lose Premium features
  • Maximum 8 members per Safety Circle

9. Intellectual Property

Lilac Venus Owns:

  • All app code, design, and features
  • The Lilac Venus name, logo, and all branding
  • All content created by Lilac Venus (guides, resources, etc.)
  • Patents, trademarks, and copyrights related to our services

You Own:

  • Your personal content (profile information, recordings you create)
  • You grant us a license to use your content for providing and improving our services

You May Not:

  • Copy, modify, distribute, or reverse engineer the app
  • Use our branding, logos, or trademarks without written permission
  • Scrape data from the platform using automated tools
  • Create derivative works based on our intellectual property

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW:

  • • Lilac Venus is not liable for damages arising from delayed or failed emergency responses
  • • Not liable for responder actions, inactions, negligence, or misconduct
  • • Not liable for technical failures, outages, or service interruptions
  • • Not liable for inaccurate location data or GPS errors
  • • Not liable for loss of data or unauthorized access to accounts
  • • Not liable for third-party actions or content

Maximum Liability: Our total liability is limited to the amount you paid us in the last 12 months.

No Consequential Damages: We are not liable for indirect, consequential, punitive, or special damages.

Note: Some jurisdictions, including South Africa, may not allow certain liability limitations. Consumer Protection Act rights are not affected by these terms.

11. Dispute Resolution

Governing Law:

These Terms are governed by the laws of South Africa. Disputes will be resolved under South African law, with jurisdiction in South African courts.

Dispute Process:

  • First, contact support at support@lilacvenus.co.za for informal resolution
  • If unresolved after 30 days, disputes may proceed to mediation or arbitration
  • Disputes are resolved individually - no class actions
  • Legal disputes must be filed within one year of the incident or they are permanently barred

12. Changes to Terms

We may update these Terms periodically. Material changes will be announced via email and in-app notifications. Continued use after changes means you accept the updated Terms. We recommend reviewing the Terms periodically.

13. Termination

By You: Cancel your account anytime from Settings. You lose access at the end of your billing period.

By Lilac Venus: We may suspend or terminate accounts immediately for violations of these Terms, fraudulent activity, abusive behavior, or legal requirements. We are not liable for any resulting damages.

After Termination: All licenses terminate. Your data is retained according to our Privacy Policy. Outstanding obligations (unpaid fees) remain.

14. General Provisions

  • Entire Agreement: These Terms, combined with our Privacy Policy and Community Guidelines, constitute the complete agreement
  • Severability: If any provision is invalid, the rest remains enforceable
  • Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement
  • Assignment: You may not transfer your account. We may transfer our rights to successors or affiliates
  • Force Majeure: We are not liable for failures due to events beyond our control (natural disasters, network outages, pandemics)
